Terms and Conditions of Agreement

CHANGE OF DATE OR VENUE
Emile must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of the wedding. Notification of any changes can be made by phone along with written notice sent via email for documentation. If an email is sent, a confirmation of receipt must be in writing. It is the client’s responsibility to confirm all arrangements at least 7-10 days prior to the event. In the event of a change of address or contact information (time, etc.) as listed, you must notify Emile.

RETAINER
The total fee for the service chosen by the Client is $3,500. A non-refundable retainer fee of $1,000 is required to hold the date of your event. No date is reserved until a retainer is received. The balance of the complete package price must be paid one month before the wedding date. If final payment is not received as set forth herein, Emile reserves the right to withhold delivery of the images and or not attend the wedding until payment is received. Upon the client's signature and payment of the retainer fee, Emile agrees to reserve the date and time specified. The retainer fee is applied towards the final contracted wedding package.   

CANCELLATION
There shall be NO refund of the retainer after 48 hours from the signing of the agreement due to the reservation of the photography date. If the event is canceled within three months of the date, the client shall pay the balance of the contract due to the high probability that Emile will not be able to further book that date. Once a balance is paid, it is NON-REFUNDABLE. Any other arrangements shall be discussed between the client and Emile. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform Emile of the cancellation. The retainer fee will be transferable up to 365 days after cancellation. The client agrees to not expect a new date to automatically be available. The client will be given the chance to reschedule but cannot be pushed ahead of other reserved clients.

UNFORESEEN CIRCUMSTANCES CLAUSE
Emile will make every effort to deliver the highest quality photographic services. In the unlikely event of severe medical, natural or other emergencies, it may be necessary to retain an alternative photographer. Emile will make every effort to secure a replacement photographer to fulfill this agreement. Emile takes the utmost care with the transportation and processing of photographs. However, in the unlikely event, the Client’s photographs are lost, stolen or destroyed for reasons outside of Emile’s control, liability is limited to the return of all payments received for the wedding package. The limit of liability shall not exceed the contract price.

SUBSTITUTION
In the event of illness or sudden event out of the control of both parties, Emile will attempt to substitute a photographer at no cost to the client. This contract will be transferable to said photographer.

PREGNANCY CLAUSE
In the event Emile would become pregnant and would be unable to attend the wedding, the client will be given two options: 1) The client will receive a full refund, minus anything already redeemed (like an engagement session,etc) and Emile is released from any future liability. Or 2) The client will allow Emile to replace herself with another photographer on the day of who is working on her behalf. Emile will remain the main POC leading up to the day, and her team will still edit, etc.

PHOTOGRAPHS
Emile shall provide edited images on a USB to the Client. Limited copyright ownership of the resulting images will be released to the Client under the following conditions:
a) The digital images are the property of the Client for personal use and for the purposes of the reproduction and distribution of photographs to friends and relatives.
b) Images may be used on personal web sites as long as a copyright notice appears near the images stating that they were taken by Emile Portraits.
c) Digital images will not be re-edited by the client.
d) Emile will retain the right to display and use the photographs taken for advertising, website, photographic contests and any other purpose thought proper by Emile.
e) The photographs are not to be published or sold for profit without written consent from Emile.

EVENT FOOD SERVICE
The Wedding couple does agree to provide a meal for Emile and those employed by the photographer.

CREATIVE LICENSE
Images may be edited at the photographer’s discretion, and delivered images may not include all images shot. The photographer reserves the creative right to edit and release only those deemed professional in quality and within the photographer’s artistic standards. By signing this contract, the client is aware of the style of photography that Emile produces.

COMPLETION SCHEDULE
The process of editing images takes 4-6 weeks after the event. Emile is more than happy to release a few images within the first week for the Client to share with friends and family.

THE UNDERSIGNED HEREBY ACKNOWLEDGE THAT THEY HAVE RECEIVED, READ,
AND UNDERSTAND THIS AGREEMENT’S CONTENTS.

Permission is hereby granted to Emile to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose. The laws of Wisconsin shall govern this agreement.
